Abstract
From the perspective of the operation of innocence presumption in criminal procedure, the article reviews the current misunderstanding and institutional defects, and proposes improving the principle of innocence presumption in China. The author thinks that, though innocence presumption principle has been established in China, there are obstacles for its establishment and implementation due to the deviation and defect of procedural idea and system design and the incoordination in legislation and judicature.
