Abstract
Criminal intention refers to the subjective intention of the crime-doer who pursues or hopes that his wrongdoing may lead to harmful social consequences.Therefore,criminal intention belongs to the subjective attitude of the doer and conforms to criminal will.However,it distinguishes itself from the factors of criminal will.In one’s criminal intention,he seeks for the special harmful result by his special act.Therefore,criminal intention is essentially different from criminal motivation,and the in the of intent is not the criminal intention.On the contrary,the intention in the crime with purpose only is the criminal intention.When we judge what the purpose of a crime is,not only the direct provisions of penal code need to be taken into account,but also the factual composition of a crime should be analyzed.
