Abstract
Since the passage of the Americans with Disabilities Act (ADA) in 1990, transportation providers have implemented unprecedented improvements in accessible transportation services. Predictably, changes of the magnitude required by ADA have resulted in problems for some transportation providers. Even good intentions can result in service failures due to the complexity of the ADA. For the first two years since the ADA was passed, 8 class-action lawsuits were filed as transit companies organized themselves to deliver ADA transit service. The issues raised by these lawsuits and discussed in this paper fall into the following major categories: paratransit plans; paratransit operational issues; passenger assistance and training issues; and maintenance.
