A Rational Review of Excessively Light Sentence——An Illustration of the Impact of Confession of One's Crime on Duty Crime Sentence

Compared with ordinary criminal cases,duty crime cases are inclined to extremely light sentences,esp.for the legal lenient punishment cases.In Criminal judicial practice,confession of one's crime has great impact on the choice of punishment,the determination of punishment extent,the application of probation and exemption from punishment,becoming the leading cause of excessively light duty crime sentence.The reason for such a situation in present China lies in the imperfect sentencing system,the missing sentencing rules,the deviational sentencing concept and the influence of factors outside the cases.In order to solve this problem,we should do our best to perfect the system,balance the justice,update the conception and restrict the influence of outside factors.
