On establishing punitive standard of state compensation for the damage in China

Abstract
Current China's state compensation standard only uses consoling standard and can not effectively suppress and prevent public rights from breaking the laws and can not effectively protect human rights.It is necessary and feasible to establish punitive state compensation standard.Construction of punitive compensation standard should rationalize the relationship between punitive compensation standard and other compensation standards and the relationship between victims and the balance of the interests of taxpayers.
