Abstract
In this text, author analyzes the functions and reaches of the Lease, as well as the types of the Lease, under the terms of new Housing Relations Act, and concludes that this Law prescribes two distinct types of lease-use of another person's apartment or house. The first type of lease is the 'Regular lease', which in essence is a legal derivate of the market housing relationship, and the other is the lease of apartment which is in social ownership, which, together with purchase of apartment should replace the former right of dwelling. Author says that the nomotechnique of legislator is not the best one, and regrets that between those two leases there is no transitory form particularly those that would pertain to some categories of persons (disabled and unemployed individuals).
