Abstract
The increasing importance of Alternative Dispute Resolution methods is a reflection of the global growth in international business which preferred these methods in resolving international disputes. This paper aims to show the relationship between Private International Law and Alternative Dispute Resolution. By exploring how Alternative Dispute Resolution could be used to resolve a dispute between parties before resorting to litigation. This can be achieved by implanting the Alternative Dispute Resolution in the terms and conditions of the contract, and enforcement of the settlement agreement in a cross-border setting. It is advisable the terms and conditions of the contract specify the alternative dispute resolution service provider and the rules governing the alternative dispute resolution process.
