Reform on the Subject System of the Civil Retrial Procedure

Abstract

There are many drawbacks and defects in the existing civil retrial procedure in China.Some obrious wrong cases can't be corrected through the retrial procedure,but the cases does not need retrial actually entered the procedure.This article provides some proposals on perfection of the system.These proposals are to abolish the people's courts authority to bring a case for retrial,to enable the people's prosecutorial office only to bring a suit for given cases to court for retrial,and to establish the system of action for retrial.
