Reform on the Subject System of the Civil Retrial Procedure

Abstract

There are many drawbacks and defects in the existing civil retrial procedure in China.Based on the careful consideration of the body system of the civil retrial procedure,this article provides some proposals on perfection of subject system.These proposals are to abolish the people's courts authority to bring a case for retrial,to enable the people's prosecatorial office only to bring a suit for given cases to court for retrial,and to establish the system of action for retrial.
