On the Status of Nation in Economic Law

Abstract

Starting from the system of subjects in economic law,this paper criticizes the viewpoint which regards nation as subject in economic law by telling the difference between public law and private law.The economic law should not belong to public law but a combination of new public law and new private law which derive from the traditional laws.Economic law can be divided into macro economic law and micro economic law.In the former,nation must be the subject while in the latter,it may not.
