On Deficiency and Perfection of the Compensation System for Mental Damage:from the Perspective of Article 22 of Our Tort Law

Abstract

The compensation for mental damage is an important legal system of Tort Law.Nevertheless,owing to the abstract provisions,dilemma is supposed to occur in judicial practice.As far as our state is concerned,the scope of application of the compensation for mental damage should be redefined,the lawsuits of compensation for mental damage relating to criminal case should be perfected,and the system of expert witnesses and state relief for the criminal victim should be instituted.
