Legal Regulation of Victim-Offender-Reconciliation in the Conception of the Austerity of Criminal Law

Nowadays,the criminal law could be called criminal law under change,and it should be reconsidered from the conception in Chinese social situation,elaborating its basis for generation, its reason for changes,and developing logical veins,to make the criminal law perfect in this process.The prosperity of the austerity of criminal law embodies the criminal law under change.In contemporary legal society,ruled by law,the austerity of criminal law is due to the value significance of the criminal law,being provided with the function of restriction,and it is embodied by the punishment scope of criminal law(the size of crime circle) and the restriction to the degree of punishment.Victim-Offender-Reconciliation(VOR) is not other but a challenge to the traditional conception of the criminal law and also a response to the conception of the austerity of criminal law.VOR aims to soften the compulsion of the criminal law and reinforce induced notion of criminal law and the function of morality reconstruction;VOR is a manifestation of the trend of private feature of public law,is also one of concrete embodiments of the principle of crimes and punishment stipulated by law,and is the best annotation of the austerity of criminal law in criminal judicial procedure or criminal judicial system.
