Abstract

Character regulation of collective land ownership is the key to perfect collective land ownership institution. Based on the eight representative viewpoints summary, the author objectively analyzes the character and cames to a conclusion that the eight viewpoints has more or less defect or shortage which can not become an ideal choice to perfect or reconstruct collective land ownership. The author insistes that the essence of collective land ownership should be the solo ownership enjoyed by farmer collectivity and the law should endow it a legal status of special civil subject, which will inevitablely establish a solid fundament for improving collective land ownership institution.
