The Evolution and Enlightenment of Our Civil Law Application

Civil law is the cornerstone of the civil society. During the course of the completion of the building of a moderately prosperous society in all respects, our civil law is supposed to highlight humanistic spirit and value, whose basic way to realize is the application of civil law. Our civil law application system and its idea has been evolving and changing with social development. Although China has established a relatively perfect civil law system, civil law application is confronted with substantially practical difficulties and challenges due to quantities of reasons. In order to promote the ideas of civil law and realize social equity and justice, we should scientifically establish the basic principles with respect to civil law application, correctly cope with the dialectical relationship betweenjurisprudenceandsense, as well as rationally examine and survey the hermeneutics of civil law, in order that modern ideal connotation and concept is endowed with civil law application system.
