Why Jurisprudence in Present Days Should Be Emphasized

Abstract

Unique legal phenomena or legal problems are surely to be observed or encountered in a specific era and thus the task of interpreting the phenomena or solving the problems is assigned to jurisprudence in that era.In present days the problems met by Chinese jurisprudence are as follows: no uniform or clear recognition of what constitutes the science of law,especially of the nature and position of law,disorder of knowledge-production,and the failure of jurisprudence to afford an intellectual support for practice.To solve these problem,we must(1) guide intellectual research to turn from concentration on policies to judicial practice;(2) make jurisprudence research return to positive law;and(3) emphasize the importance of methodology in jurisprudence research work.The study of methodology,to some extent,can furnish a reference to the structure of jurisprudence,create a peculiar spirit and expedite a passage to lay down the criteria of jurisprudence scholarship.Indeed,any scholarship without underlying methodology is susceptible to doubt and controversy.
