A new study of basic theories of priority right

Priority right is a kind of legal mechanism to realize social justice.Explanation of the conception and characteristics of occupation right is of great significance to property law legislation of China.Research into priority right should explore the basic ideas of priority right based on philosophy,understand the essence of the system,use comparison analysis method to study the legislation of different countries from the diachronic and synchronic angle,create priority right system with Chinese characteristics by studying the original and current development trends and by selecting good points and discarding bad points and according to the situation of China.At last,internal structure of priority right should be systematically completed and the relationship between priority right system and other systems should be rationalized to realize maximization of the function of priority right system.
