A Solution to Free Flow of Mining Right in Strict Restriction——Discussion on Nothingness of Mining Right

Academia believes that mining rights should be a free flow of the property,thus they blame the strict legal restrictions.In fact the strictly limited object of the law is mineral exploitation right instead of mining right.However academia on mining right with the same object of the laws strictly limit,which can be restricted by law strictly scientific.To precisely define the right of a free flow is the necessary condition,thus the nothingness of mineral right should be removed and an independent of the mineral right and mineral development right be reconstructed.Mineral right that is independent of national ownership of mineral right and mineral exploitation should be a free flow of the property.At the same time,the laws which strictly limit the transfer of the mineral development right need classification reform.
