Abstract

It is not only one of key elements of subject of crime but also the important factor to judge whether one's own act is crime to ability of Criminal Responsibility in theory of ability of Criminal Responsibility in China. According to concept, key elements and influential factors of ability of Criminal Responsibility, the system of ability of Criminal Responsibility is re-constructed. This article thinks it is not only one of key elements of subject of Criminal Responsibility but also the essential to judge whether subject of crime can endure Criminal Responsibility to ability of Criminal Responsibility.
