Abstract

There are different theories about the role of criminal responsibility in criminal law.Criminal responsibility should be a mandatory judicial offender under the criminal punishment or a simple negative evaluation of the criminal.The relationship among crime,responsibility and penalty should take the model of crime——criminal responsibility.Only in this way,can the relationship among crime,responsibility and penalty be cleared off so as to position the criminal responsibility and better guide the judicial practice.
