Abstract
The criminal law of our country stipulates the definition of the crime as the behavior that should be punished,and should bear criminal at the same time.Such two respects are different from meaning,which creates doubts on study and judicial practice.Social endangerment is the basic characteristic of crime.The lawful characteristic of crime of thatshould bear criminal responsibilityshould be replaced by should shoulder criminal accountability,and it is also suggested that the minimum age for criminal responsibility in law be adjusted from 14 to 13.
