On the Justice System of Aufkaungsrecht in Administrative Procedure

Abstract

The system of Aufkaungsrecht,a big issue in Procedural Law as it is,receives little attention as it deserves in the area of Administrative Procedure.A definition for the procedural model of the Authority System,also a supplement to System of a Litigant as well as the Procedural Model,this term has its special value in the two currently leading law systems.It not only exerts its effect in Administrative Procedure area which values the Authority System,but also in legal norms that accounts for its function.It therefore has its theoretical significance in its urgent application in reconstructing the Administrative Procedural Law.
