The Defects and Perfection of Personal Property Mortgage Legal System

Abstract

As a result of traditional property mortgage legal system,personal property mortgage legal system,a perfection in theory,is in conflict with the actual need of the society.It is called to account by many scholars because of its natural defects in theory which cannot be overcome.The key points of this system are the restrictive way,the scope of mortgage and the efficiency of the restriction.The article tries to analyze the defects of this system and manage to solve these theory obstacles.
