The Comparison of Anti-Unfair Competition Laws Between China and Germany

Germany is the origin of modern anti-unfair competition law.The first law of Anti-unfair competition,legislated in 1896 and amended short later,has been playing an important role to improve the development of German economy now.China's first competition law-Anti-unfair law,legislated in 1993,has run for almost ten years.This paper presents the comparison between the two countries in terms of the features of the concepts and variety of un-fair competitive activities, the adoption of exception system,legal responsibility and the execution organs .Such comparison can clarify the issues that the relationship of the Anti-Unfair Competition Laws and the Anti-Trust Laws shall be dealt with.And China should take the relevant measures of improvement about Anti-Unfair Competition Law.
