Abstract
The mediation and guarantee system laid down in The Regulations of Civic Mediation Problems in People's Court means that in the court mediation process the guarantee is supplied by the case person concerned and the person beyond the case for regulating the conduct of the agreement.It can not be replaced in promoting the implementation of debt and intensifying the effectiveness of mediating agreement,at the same time considers the right and interest of the debtors.Owing to mediation and guarantee occurring in the process of lawsuit,it is characteristic of the law position of the wediation and guarantee persons,effectiveness of guarantee and the ineffective legal results.
