Abstract

Shall victims suffering from traffic accidents which constitute work injury,enjoy both the right to be compensated for traffic accident and the right to be compensated for insurance against work injury? It is controversial in both legal theory and judicial practice.The essay analyzes relevant stipulations in our law specifically,and puts forward that victims shall enjoy both the rights in cases that compensation for traffic accident and treatment of insurance against work injury coincide.It is conducive to protect the rights of the weak labor and to construct a harmony society.
