On the path and limits of judicial guarantee to Chinese social rights

Abstract
Certain path and limits of judicial guarantee to social rights must take basic effect of social rights as foundation. In China,guarantee social rights should take law litigation as principle,the constitution litigation exception. At same time ,to guarantee degree ,in nation respect and protect duty level to have completely justiciability,but in duty level with only the lowest limit justiciability.
