Predicament and Way out:Theoretical Correction of Crime of Credit Card Fraud

Credit card fraud and the crime of fraud are overlapping,rather than of a relationship between being specific and general.The controversy on the act of using other's credit card is a result of the misinterpretation that takes the credit card fraud as a special form of the crime of fraud.The fraud on credit card should be independent from the crime of fraud,and its constitutive elements should be understood as acts with intention for illegal possession,jeopardizing credit management systems,abusing banking credit and violating others' property rights.
