Comparative Analysis on the Concept of Consequential Offense

Abstract

Consequential offense in criminology of civil legal system refers to the crime in which both behavior and consequence are stipulated,which has nothing to do with the crime suspended state,and legislations about consequential offense show the tendency of Erfolgsunwert;while in Chinese criminology,consequential offense refers to the crime whose symbol of establishment is occurrence of result,which is of significance to crime establishment.Some results of consequential offense can be judged easily by the legislation characteristics,while others should be explained on essential crime theory.Consequential offense,as a corresponding type of criminology to behavioral offense,concerns itself only with the issue of crime establishment and has nothing to do with the concept of inchoate or unconsummated criminal states.
