Abstract

Due to the particular of the subrogation lawsuit,not only the balance of the rights and obligations of the interested parties is determined by the setting up procedure of the subrogation lawsuit,but also the rights and obligations of the other civil litigant and the interested related party are influenced.So,it is important to findout a best connection with justice and efficiency inorderto safeguard the interest of the every party in subrogation lawsuit.There are some rational factors in setting up procedure of the subrogation lawsuit of Chinese Contract Law,but there exist some obvious parts should be perfected.
