Abstract

People's Republic of China Contract Act stipulates credior's subrogation,but that isn't perfect.Through studying,the writor thinks that the right the credior can exercice is not limited to the creditor's right that belong to debtor,and the civil lawsuit is not the only way for credior to exercise the subrogation.The credior have the right to choose exercising subrogation dirctly or by civil lawsuit.
