Discussion on the Nature and Exercise of Mineral Exploitation Rights

Abstract
Under Article 123 of Property law, the legally obtained mineral exploitation right was protected by law. However, because of the natural characteristics of the object of right, as well as the participation and penetration of power from its generation, exertion and loss, the mineral exploitation right was distinguished from other rights, and it has high probability to conflict with other rights. Therefore, it is of vital importance for exploring the multidimensional of the features of mineral exploitation right and researching the coordination with ownership of mineral resources, mineral exploration rights, land-use rights for construction, rights of contract for management of land, and rights of way.
