Intellectual property right abuse and anti-monopoly legislation-an interest-balance view

The paper looks at the dual role of intellectual property rights in promoting and obstructing competition.It holds that the struggle against monopoly in the field of intellectual property rights is an important issue in the contemporary anti-monopoly legislation.It further explores the relationship between the two from the perspective of interest balance.By comparing and borrowing relevant experience in legislation abroad we can improve our legislation in such a field.
