Abstract

As the function of intellectual property is more important in the development of international economy and society, the anti-monopoly problems in the field of intellectual property become outstanding more and more. During the post- WTO ages, the restriction upon intellectual property abusive behavior has become a significant task for international anti-monopoly. In China, as the influence arising from foreign-related disputes upon our nation and the enterprises is increasingly deep, it is necessary for the academic circle to make further study into the legislative points, principles, measures of the anti-monopoly in the field of intellectual property in our country from the angle of the government and the enterprises through penetrating analysis of the relationship between intellectual property and anti-monopoly, the intellectual property abuse and the restriction by the anti-monopoly legislation.
