Abstract
The implementation of the criminal policy of temper justice with mercy is not only the inherence,development and improvement of the past criminal justice policy,but also an inevitable choice that the procuratorial agency should make in order to perform legally supervisory function better in the construction of a harmonious society.The procuratorial agency should not only implement the criminal policy of temper justice with mercy to the particular case,or the particular case at the particular phase while abiding by the existing law systems,but also establish the appropriate lawsuit system concerned in the future reform so as to meet the demand of the development of our lawmaking society.
