On the Limitation of Prosecution of the Case of Private Prosecution and the Lawsuit of Public Prosecution

Abstract

The author has analyzed the differences between the case of private prosecution and the lawsuit of public prosecution, and points out that these differences are the direct reasons for different prescription by law for each as to the limitation of prosecution. The author also deals with the significance of the prescriptions in such aspects as realization of justice of action, enhancement of the efficiency of action, and social stability. At last, the author gives some suggestions about the amendment of the law.
