Abstract
The paper analyzed the position of legal system of intellectual property rights in the strategy of innovation and its function on innovation.It pointed out that,in the process of formulating and carrying out the strategy of innovation,the nation must give first priority to intellectual property rights,and turn the innovated knowledge from the sharable into the private rights,so as to promote innovation in future.Considering the relation between legal system of intellectual property rights and innovation,the paper brought in a mechanism to generate innovation in the enterprises and the government.It means that the enterprises are to play the leading roles in innovation,and the government's function is to create an agreeable macro environment for the application of intellectual property rights laws.
