Abstract
In modern industrial society,it is ordinary problem that labor rights are aggrieved by industrial injury.It brings the difficulty to judge that labor has right to compensation of Industrial injury and right to compensation of tort at the same time.Rationally dealing with them is necessary for harmonious society.In the future,the legislation of Industrial injury insurance should make specific and clear regulation to compensation of Industrial injury and compensation of tort.It is better for judicial activity that different cause of industrial injury adopts different regulation to resolve disputes.
