The law revision in the last years of Qing dynasty is the connecting point of the ancient criminal law and the modern criminal law,so is the voluntary surrender system.The voluntary surrender system of criminal law in Taiwan area originates from the Temporary New Criminal Law issued by Beiyang Government with slight revising.Both the criminal law of single file and the current code of criminal law round about the founding of the People's Republic of China in Mainland stipulate the surrender system,and define the concept of voluntary surrender and the system of doing deed of merit.The current code of criminal law is the succession of the voluntary surrender system in ancient criminal law in the aspects of the condition of voluntary surrender,lenient punishment and so on.It reflects the development of the legislative technique of criminal law and the level of civilization which can be attributed to the notable development of the definition of voluntary surrender,the concept of voluntary surrender,the manner of voluntary surrender,the time of voluntary surrender,the object of voluntary surrender,the application types of crime,lenient punishment and so forth.
