On the Construction of an Ecological Property Rights System and the Protection of Ecological Environment in China

This thesis holds that the low efficiency of the ecological resource in China is rooted from the rights,but the solution to the improvement of the efficiency is not necessarily the privatization of the rights.Therefore,with regard to the reform of the ecological property rights system in China,on one hand,an incentive mechanism shall be introduced to the establishment of an market ecological environment public property rights system,and on the other hand,the operation model of public-owned and public-operated in the traditional public-owned-public utilized-public-operated shall be broken,making a technical separation of the rights of utilization and the rights of operation according to the public feature and the external feature of ecological resource,clarifying the respective powers and functions of the rights of utilization and the rights of operation,introducing the participation of the operation and competition of non-state-owned enterprises such as private enterprises and foreign-invested enterprises,with the purpose to make state-owned enterprises to retreat from the operation of part ecological resource in order to form a pluralistic market operation system of ecological resource and a model of mixed management of ecological property rights and hence to realize an effective protection of ecological environment in China.
