Abstract
To prevent the occurrence of crimes by taking advantage of duty,the construction of administrative power order based on the principle of the rule of law is a must.Such power order of the rule of law can ensure the smooth functioning of power on the track of law and avoid the abuse and alienation of power.China’s current high incidence of crimes by taking advantage of duty is closely related to the over-centralized power structure and the personalized tendency of power authority.In order to construct a legal order for the execution of power,we must strengthen the legal supervision over the use of power,enhance the open and transparent exercise of power,further promote the scientific allocation of power and reinforce the separation and check and balance of power,while upholding the Party’s leadership.
