Abstract

According to the 196~th clause in criminal law of our country,the crime of the credit card fraud means that the actor takes various kinds of ways to fraud by utilizing the credit card for occupying illegally and has procured the larger quantity of property. In the judicial practice, we should take notice of several problems in concluding crime of the credit card fraud. The first problem is the boundary about crime and non-crime.The second problem is the way of stealing and using others' credit card.The third problem is the way of overdrawing maliciously.
