A Reflection on Improving China's Rural Land Requisition Compensation System in the Process of Urbanization

There exist some systematic disparities on many aspects of China's rural land requisition compensation system,the main forms of which are that the compensation criteria of land requisition were relatively low and inequitable,the scope of land requisition was too broad and the purpose of land requisition beyond the category of the public interest,the scope of compensation for land requisition was narrow,the way of compensation for land requisition was single,the amount of compensation was determined directly by the government,lacking of democratic procedures,and the farmers have no right to participate,and the gist of land compensation fee distribution was faulty.According to the above disparities and using foreign land requisition compensation system for reference,this thesis puts forward some relevant suggestions on improvement of china's existing land requisition compensation system,that is: following the market principles,enhancing land compensation standards,using laws to make clear the public interest,the scope of compensation should corresponding to loss of land expropriated from farmers,varying the ways of land requisition compensation,establishing compensation dispute arbitration institutions and perfecting Judicial channels,and distributing land compensation fee rationally.
