Abstract
Due to the intrinsic characteristics of insurance contracts,the insured play an important legal role in insurance contracts.However,the relation between the insured and the insurers is always in an unbalanced position because of the trading habits in the insurance industry. In order to avoid the interests of the insured being harmed,our country is supposed to make the insurance law perfect by learning references from foreign legislative systems and considering actual conditions of our country.
