Abstract
With epistemology and characteristics of procedural proofs, the thesis distinguishes the legal truth and objective truth and assures the justice of legal truth. Basing on this, the thesis particularly study the possibility of scopes of objective truth in judge's discretion and the its necessity in penal cases.
