Research into American Punitive Damages System——Concurrent Study of Establishment of Punitive Damage System in Legislation of China

Abstract

America inherited the punitive damages system originating in English common law at colonial times.In 1960s the punitive damages system fast developed in America.Punitive damages are obviously different from compensatory damages and criminal fine.Punitive damages system has both positive and negative impact and influence on social life.The supreme court of the U.S.A standardizes the application of punitive damages system by starting with the proper proportion between the punitive damages and the compensatory damages.
