Abstract
Since the end of cold war, some countries in international community often intervene in other countries' domestic affairs for the reason of disaster. Humanitarian intervention is related to at least two controversial categories in international law .One is the relation between human rights and national sovereignty, the other is the relation between protection of human rights by domestic law and by international law. Through analyzing and discussing these two relations, generally, humanitarian intervention possesses some degree of legitimacy , however, its application in practice must obey some necessary principles and accept some necessary restrictions.
