Chinese Voluntary Surrender System and Reform Proposals

Voluntary surrender system is one of the commonly used sentencing systems of the national criminal legislation.The system of voluntary surrender to justice has its own unique values.It could realize the purpose of criminal punishment,guarantee the principle of suiting punishment to crime and criminal responsibility and save the judicial resources.The author of this paper,however,holds a different opinion advising to reform the voluntary surrender system in order to maintain the positive factors and eliminate contradictions between its values and provisions.
