The attribute of the direct claim of the third party in marine liability insurance is an important basic theoretical problem,which directly impacts the construction of the legal system of the direct claim of third party in marine liability insurance.The direct claim of third party in voluntary marine liability insurance should be defined as a legal transferred right,while the direct claim of third party in compulsory marine liability insurance should be defined as a legal independent right,because of different characters between voluntary marine liability insurance and compulsory marine liability insurance.
