Abstract
This article explores the definition, theoretical value, practical value and the judgment of the formation of illegal possession in criminal law from the special angle which is quite different from the traditional research. The author states that the formation time of illegal possession, to which great importance needs to be attached, is the new research question in relation to the study on the purpose of illegal possession and reasonable conviction and penalty.
