Discussion on Land Use Planning System as a Part of Property Rights Rules

From the perspective of land property rights theory,this article reveals land use planning system is a part of property rules in nature. It's objective economic rights exist in the process of land use,but land development rights are to be formed by the planning control in law. Land use planning plays the role of land development rights allocation. Making plan is to allocate the land development rights,and planning management is to protect the transaction of land development rights. Planning system arrangement depends on the social transaction cost and government targets at the time,then it forms the development rights structure and distribution rules,and eventually influences the efficiency of land use. Therefore,we should research on the land use planning system in China as a part of the land property rules,and actually provide critical theoretic support for its innovation.
